Following the implementation of the plastic bag regulation, companies will also submit recycling participation fee declarations for products such as tires, accumulators, batteries, oil and electronic goods within the scope of the regulation that has been in effect since the beginning of the year.
With the regulation made in the Environmental Law, the second phase of the application was started this year, while the recycling participation fee started to be collected for the bags, which became paid as of January 1, 2019.
The practice of collecting recycling contribution fees for tires, accumulators, batteries, mineral oil, vegetable oil, electrical and electronic goods, pharmaceuticals and plastic, metal, glass and wood packaging started on January 1, 2020.
The recycling contribution share amount, which was 15 kurus per piece for bags, was determined as 2-10 liras per piece for tires, 5-50 kurus per kilogram for accumulators, 2-15 liras per kilogram for batteries, 10-50 kurus per kilogram for oils, 20-30 kurus per kilogram for electrical and electronic equipment, 1 kurus per box or bottle for medicines, and 1-10 kurus per liter for packaging.
Those importing and placing these products on the market will pay this share by submitting a declaration.
The Ministry of Treasury and Finance will also determine the procedures and principles regarding the submission and implementation of recovery contribution share declarations. The Ministry is expected to issue a communiqué on declaration and payment dates and other issues for new products subject to the recovery contribution share.
“REFLECTED ON THE CONSUMER”
Emre Kartaloğlu, President of the Union of Chambers of Certified Public Accountants and Certified Public Accountants of Turkey (TÜRMOB), said that it will be a challenging process for companies to pay a recovery participation fee for many products after the bag.
Stating that it is inevitable that the participation fees to be taken from the companies will be reflected on the consumer, Kartaloğlu said, “For example, if the tire factory will pay a participation fee of 10 lira per piece, it will definitely reflect this in its prices.”
Stating that the functioning of the application is still unclear and that the Revenue Administration is trying to simplify and facilitate the regulation with the communiqué to be issued by the Revenue Administration, Kartaloğlu said:
“In the bags, the points of sale were making a declaration, but in the new products, it says ‘who puts it on the market’. Who puts this product on the market, the producer or the consumer? Definitions should be clarified. Who puts the tire on the market, the factory or the dealer? It should be limited as a manufacturer or importer. It may become a little clearer after the communiqué is issued, but a serious problem awaits us. Neither businesses nor consumers are aware of this practice.”
“THE PENALTIES ARE VERY HEAVY”
Explaining that the declarations regarding the new products will be added to the bag declaration and the whole process will be completed with a single declaration, Kartaloğlu said, “The participation fee amounts for January should be declared at the end of February.”
Pointing out that the application should be clarified for the packaging materials covered, Kartaloğlu noted the following:
“For example, is the stretch film in which the cheese bought from the market wrapped also a packaging material? What is the limit of packaging? It is a difficult regulation to implement and the penalties are very heavy. It needs to be simplified. Our request is not to impose fines until the uncertainties regarding the implementation are clarified. Those who do not fulfill their obligation to notify and provide information will be fined 22,109 liras. Those who provide false and misleading information in violation of the obligation to notify and provide information will be punished with imprisonment from 6 months to 1 year.”
